Definitions

  • Soalsurf: the organization operating these terms and conditions.
  • Client: the person who purchases a service or product from Soalsurf.
  • Participant: anyone involved in the activities or arrangements described in the agreement.
  • Package: services, activities and facilities offered by Soalsurf, such as rental or sale of equipment, transportation, instructions and guidance.

Applicability of these terms and conditions

  • These terms and conditions apply to all offers and agreements between Soalsurf and a counterparty, unless otherwise agreed.
  • Dutch law shall apply to all agreements between Soalsurf and an opposing party.

Agreements

  • Agreements between Soalsurf and the other party may be written or oral.
  • The person who books an activity for others is responsible for those persons.
  • Written agreements can be confirmed via email, WhatsApp, text message or online booking system.
  • Soalsurf is not liable for damages, including loss of income and injury, unless there is intent or gross negligence.

Payment

  • The price must be paid before the start of the activity through the online booking system or on site at the surf school.
  • Products for which an offer or invoice has been sent must be paid prior to delivery within the specified period.
  • Reservations for group activities such as company outings or children's parties are final after written confirmation from Soalsurf and a 20% deposit by the other party.

Consideration of risks

  • Each student who participates in an activity at Soalsurf accepts the risks and dangers associated with the activity.
  • By participating in an activity at Soalsurf, a student agrees to the level and and intensity of the activity.
  • Any physical limitations or health risks must be reported to Soalsurf prior to the activity.
  • Soalsurf reserves the right to exclude participants from participating in activities if their health condition poses a risk to themselves or others.
  • Surf lessons at Soalsurf involve risks, including the risk of physical injury. Therefore, it is imperative that the participant have full attention and concentration during the surf lesson and not take unnecessary risks.

Safety and responsibility of participants

  • Soalsurf participants are responsible for their own safety and risk assessment before participating in activities.
  • Participants must follow the instructions of the instructors and use the equipment provided (wetsuit, impact vest, lycra, helmet, trapeze, kite, windsurfing sail, wing, foil and kiteboard) as directed. The equipment must not be transferred to others.
  • Consuming or being under the influence of alcohol and/or drugs is strictly prohibited during activities.

Age and health requirements

  • Surf lessons are open to participants as young as nine years old, provided they do not suffer from an illness or mental disorder that could endanger their own health or the health of other persons.

Safety measures

  • Objects such as jewelry (earrings, necklaces, bracelets, etc.) that may pose a danger to participants are not to be brought during surf lessons.
  • Long hair should be tied with an elastic band.

Cancellation and refund

  • No refunds will be given for cancellation or change of class due to adverse weather conditions or other reasons. The lesson can be scheduled at a later time through the booking system, with lessons valid for two years.
  • Classes cannot be rescheduled or cancelled within 24 hours before the class begins. 

Liability

  • Soalsurf will not be liable for any damage, loss, theft, injury or accidents during the activities unless there is intent or gross negligence.

Return of materials

  • For rentals, the materials, including the wetsuit, must be returned at the appointed time. Additional fees will be charged for late returns.

Other provisions

  • Soalsurf reserves the right to amend or supplement the terms and conditions. The amended terms and conditions will apply to all current and future agreements.
  • If any provision of these general terms and conditions is declared void or voidable, the remaining provisions shall remain in full force and effect.
